Texas Attorney General Ken Paxton stated in his findings that are recent day-to-day fantasy sports (DFS) is a form of online gambling and unlawful in his state.
Texas Attorney General Ken Paxton (R) is in agreement with opinions issued in New York, Illinois, and Nevada that day-to-day dream sports (DFS) operators are in breach of state legislation and are running gambling that is illegal.
In his response to a query made by Texas State Rep. Myra Crownover (R-District 64), Paxton linked the element of opportunity associated with the competitions to gambling.
‘Paid daily ‘fantasy sports’ operators claim they could legally operate … but none of their arguments square with existing Texas law,’ Paxton wrote in a statement. ‘ as the result of games in daily fantasy sports leagues depends partially on possibility, a person’s payment of a fee to participate in such activities is just a bet.’
Unlike his colleagues in New York and Nevada, Attorneys General Eric Schneiderman and Adam Laxalt, Paxton didn’t announce any immediate repercussions that are legal order DFS market leaders DraftKings and FanDuel to cease operations in his state. Yet.
So You’re Telling Me There Is a Chance
Paxton isn’t terribly interested in venturing to the complicated debate of determining if day-to-day dream contests constitute gambling or competition that is skill-based. That’s because in his state, perhaps the slightest component of chance overrides other factors.
‘Unlike other states, Texas legislation only calls for ‘partial chance’ for one thing to be gambling; it does maybe not require that chance predominate,’ Paxton said.
The 2nd problem Paxton has with DFS is a house is involved, much as just how gambling enterprises operate with regards to poker. The house is facilitating the game for a set fee, but not actually taking a cut of the losses in other words.
Whereas in traditional fantasy sports, there is no house, thereby resulting in Paxton’s belief that traditional fantasy sports leagues are not gambling, and DFS is.
If DFS operators didn’t just take a cut off each individual entry fee and instead paid-out the complete pot, since many regular dream leagues do among friends, that would help DraftKings and FanDuel’s cause. It might also make them broke.
‘Basically, it’s prohibited gambling in Texas if without a doubt on the performance of a participant in an event that is sporting the home takes a cut,’ Paxton said.
Texas, New York, and Illinois are all in the top five in terms of state population. Combined, the three represent nearly 19 per cent of the total census in the US, a possibly crushing blow for DFS operators should their competitions be banned from every one of these states.
DraftKings and FanDuel responded to Paxton’s declaration, the former saying that the AG has a ‘fundamental misunderstanding of DFS.’ FanDuel echoed those views by asserting, ‘Today’s advisory opinion by the Attorney General of Texas is established for a misinterpretation of the law and misunderstanding of the facts about fantasy sports.’
Both platforms said they mean to continue running lawfully in the state.
Paxton’s Next Ruling
A jury that is criminal might be in Paxton’s future, but not against DraftKings and FanDuel. Rather, the state’s top legal authority will be defending himself on fees of securities fraud.
Last August, Paxton posted $35,000 bail after he was arrested for allegedly misleading investors during his work with the private sector before becoming attorney general. The case that is ongoing go to trial sometime in 2016.
Paxton faces between five and 99 years in prison, not to mention, the relinquishment of his office. So DraftKings and FanDuel should just outlast him as AG and hope the next guy features a vision that is different.
New York On The Web Poker Bill Reintroduced by State Assemblyman Gary Pretlow

New York on line poker has returned to Albany, thanks to Assemblyman Gary Pretlow (D-District 89) reintroducing AB9049 to the state’s legislature. Poker may be cruising in on the backs for the current race, parimutuel wagering, and breeding regulations, which are also addressed in Pretlow’s bill.
The assemblyman has been campaigning for Internet poker since 2014, and the longtime member of the state legislature is wasting no time into the new year continuing that quest. Pretlow’s proposition declares poker become a game that is dominated by ability in the place of luck, with significant taxation implications and state revenue that he claims might be generated from such legalization.
‘Presently, numerous brand New York residents are participating in illegal, unregulated and unsafe gaming operations which provide games of chance on the internet,’ Pretlow states in the proposition. ‘This bill enables the state to license operators that meet up with the high standards set by the state and offer limited games of poker which need a level that is high of.’
AB9049 would charge licensees a one-time $10 million fee and taxation gross revenues at 15 percent.
Tough Act to Sell
But Pretlow has did not attract support from his peers within the 3 years he’s pushed for iPoker, also it doesn’t appear that 2016 will be any various only at that juncture.
New York is one of several states currently in a battle that is hostile daily fantasy sports (DFS) leaders DraftKings and FanDuel. State Attorney General Eric Schneiderman has not only declared DFS to be unlawful, buying the platforms to shut (which both companies experienced temporarily overruled in court), he’s also would like to fine the operators upwards of $5,000 per violation, a punishment that could potentially total $3 billion.
The penalty would also impact the many investors in these two DFS companies, including NBC, Fox, Comcast, and private equity firms in addition to placing both businesses in bankruptcy.
‘DraftKings and FanDuel are operating illegal sports betting sites under New York legislation, evoking the same kinds of social and economic harms as other forms of illegal gambling,’ Schneiderman stated in November. ‘ The Attorney General’s job is to enforce New York State law, and the statutory law listed here is clear.’
Changing that gambling law, as Pretlow has clearly learned by now, will be no effortless feat.
Pretlow must realize that passing iPoker is unlikely in New York State, using the ongoing DFS case expected to last throughout much of the entire year. Enacting legislation to authorize any form of Internet gambling as the state’s attorney general fights it in court seems like an extremely long shot.
That might be why the assemblyman came back the bill to Albany this with little fanfare week. The Racing and Wagering Committee will discuss the legislation at a hearing that is future.
Pretlow highlighted his motivation in a Roll Call op-ed summer that is last.
‘As nearby states such as New Jersey and Delaware have adopted well-regulated systems, they have seen an increase that is corresponding tax income,’ he wrote. ‘The security technology they have used has not just kept gaming secure of their borders, it offers developed a legal system where law enforcement can crack down on the fraud and just about any illegal activity that currently runs rampant into the robust online black market.’

Las Vegas Connections

Caesars’ Colosseum, Carey’s venue, also serves as home for megastars Celine Dion (recently widowed and on hiatus until February) and Elton John when doing on the Las Vegas Strip.
Meanwhile, as a gaming tycoon, Packer is no stranger to Sin City himself. The Australian’s Alon Las Vegas property, where in fact the brand New Frontier once endured, is slated to open in 2017. The new casino is expected to cost $4 billion.
Packer stepped down as chairman of Crown Resorts in 2015, but continues to oversee his investment that is private firm still has majority ownership into the business. The resort that is 3.5-million-square-foot end up being the perfect environment for what will likely be a wedding for the record books, if the couple can wait that long.
Well-known for being truly a diva and her over-the-top life style, Carey and then-husband Nick Cannon shutdown Disneyland in order to restore their wedding vows for a time that is fourth 2013, so we can probably expect an extravaganza for the most recent Mrs.-Packard-to-be’s nuptials.
Third Time’s the Charm?
Carey’s first wedding to music executive Tommy Mottola lasted 5 years. At 22 years her senior, Mottola married Carey when she was just 23.
Her marriage that is second came years after her split from Mottola. This time it was Carey in the role that is senior as she is a decade older than Cannon. On her third go at wedding, Carey is marrying someone finally her own age, Packer being simply two years older than the star.
‘as soon as their friendship turned romantic, they have wanted to spend every brief moment together,’ a source told E! News. ‘with them, you can’t help but believe in real love. in the event that you invest even five moments’
Packer is hoping to give Carey, who may have made a profession performing about love, the fairytale ending the singer has so long sought. But whether effort number three for both will stick is obviously a bet we’ll see in a likely recreations book somewhere.
